1. Acceptance of terms

By accessing or using the website at evilin.me (the "Site") and any products or services we provide (the "Services"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, please do not use the Site or Services.

These Terms form a binding agreement between you and EVILIN LLC, a limited liability company registered in Wyoming, United States ("we," "us," or "our").

2. Who can use our Services

You may use the Services only if you are at least 16 years old and capable of entering into a binding contract. If you are using the Services on behalf of an organization, you confirm you have the authority to bind that organization to these Terms.

3. The journal and related content

3.1 Physical journal

We sell a physical reflection journal titled "Evil in Me" and related products. Purchases made through Amazon are subject to Amazon's own terms and policies. Purchases made directly through the Site are subject to these Terms and our Privacy Policy.

3.2 Not medical or mental health advice

Evil in Me is a self-reflection journal and creative product. It is not a substitute for professional mental health care, medical advice, diagnosis, or treatment. If you are experiencing mental health difficulties, please consult a qualified professional. In case of emergency, contact local emergency services or a crisis hotline.

3.3 Digital products

We may offer digital products and services (including a planned online companion service). Specific terms for digital products will be provided at the time of purchase or sign-up and will supplement these Terms.

4. Your account (when available)

If account creation becomes available on the Site:

  • You are responsible for maintaining the confidentiality of your login credentials
  • You are responsible for all activity that occurs under your account
  • You must notify us immediately of any unauthorized use
  • We may suspend or terminate accounts that violate these Terms

5. Purchases and payments

5.1 Direct purchases

When you buy directly through the Site, payments are processed by third-party payment providers (such as Paddle or Stripe). By making a purchase, you also agree to the applicable payment provider's terms.

All prices are shown in US dollars unless otherwise specified. Applicable taxes and shipping costs are added at checkout.

5.2 Shipping and fulfillment

Physical products are produced and shipped through our print-on-demand partners. Delivery times vary by destination. We are not responsible for delays caused by carriers, customs, or events beyond our reasonable control.

5.3 Refunds and returns

  • Physical journal (direct purchase): if your item arrives damaged or defective, email cc@evilin.me within 14 days of receipt for a replacement or refund
  • Unopened, unused journals: returnable within 30 days of delivery for a refund, minus return shipping costs, at our discretion
  • Digital products: because of their nature, digital products are generally non-refundable once delivered, except as required by law
  • Amazon purchases: refunds and returns are handled by Amazon under their policies, not by us

6. Intellectual property

6.1 Our content

The Site, the journal, and all related materials – including text, prompts, illustrations, design, logos, and the names "Evil in Me" and "evilin.me" – are owned by EVILIN LLC or licensed to us. They are protected by copyright, trademark, and other intellectual property laws.

6.2 Limited license to you

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes. When you purchase a physical or digital product, you receive the product for personal use; you do not receive any ownership of the underlying intellectual property.

6.3 What you may not do

You may not:

  • Copy, reproduce, or redistribute our content without written permission
  • Resell or commercially exploit any part of the Site, journal, or digital products
  • Reverse engineer or attempt to extract the source code of any digital service we offer
  • Use our trademarks, brand name, or logos without permission
  • Scrape, crawl, or collect data from the Site in an automated way that burdens our infrastructure
  • Use the Site or Services for unlawful purposes

6.4 Your content

If you submit any content to us (feedback, testimonials, social media posts tagging us, emails), you grant us a non-exclusive, worldwide, royalty-free license to use, display, and reproduce that content in connection with our business, unless we agree otherwise in writing. You represent that you have the rights to submit that content.

7. Third-party services and links

The Site may link to or integrate with third-party services (Amazon, payment processors, email providers, social media platforms). We are not responsible for the content, policies, or practices of third parties. Your use of those services is governed by their own terms.

8. Disclaimers

8.1 "As is"

The Site and Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by law.

8.2 No guaranteed results

While we hope our journal is useful, we make no promises that using it will produce any particular result or outcome. Self-reflection is personal, and results vary.

8.3 Availability

We do not guarantee the Site or Services will be uninterrupted, error-free, or always available. We may suspend, modify, or discontinue any part of the Services at any time.

9. Limitation of liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or Services
  • Our total liability for any claim related to the Site or Services will not exceed the amount you paid us in the 12 months before the claim (or USD 100 if you have not paid us anything)
  • These limitations apply even if we have been advised of the possibility of such damages

Some jurisdictions do not allow certain limitations of liability, so some of these limits may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless EVILIN LLC, its officers, employees, and partners from any claims, damages, or expenses (including reasonable legal fees) arising from your violation of these Terms or your misuse of the Site or Services.

11. Termination

We may suspend or terminate your access to the Site or Services at any time, with or without notice, if we believe you have violated these Terms or applicable law. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and dispute resolution) will survive.

12. Governing law and disputes

12.1 Governing law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles.

12.2 Informal resolution first

Before filing any formal claim, please email legal@evilin.me and allow us 30 days to try to resolve the issue informally.

12.3 Forum

Any dispute not resolved informally will be brought exclusively in the state or federal courts located in Wyoming, United States, and you consent to the jurisdiction of those courts. If you live in a jurisdiction where mandatory local law gives you the right to sue elsewhere, those rights are preserved.

13. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top and, where appropriate, notify you by email. Your continued use of the Site after changes means you accept the updated Terms.

14. Miscellaneous

  • Entire agreement. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Site and Services.
  • Severability. If any provision of these Terms is found unenforceable, the rest remains in effect.
  • No waiver. Our failure to enforce any right does not mean we waive it.
  • Assignment. You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
